Q. What is SWAE?

A. Operating chiefly as an outfitting and apparel brand, SWAE explores concepts in automotive and material sciences.

Q. Will sold-out items be restocked?

A. Beyond our Logo Capsule, most products are not restocked. We recommend signing up for the SWAE Dispatch and following @swae.us on Instagram to get a heads up on new projects and product releases.

Q. What payment methods do you accept?

A. SWAE accepts most major credit cards including Visa, MasterCard, American Express, and Discover. You can also use Paypal payments on our online store.

Shipping

Q. What couriers do you use?

A. To ensure you receive the best service SWAE utilizes FedEx, USPS, and UPS for domestic shipping. DHL for international shipping. 
 

Q. How much is shipping?

A. SWAE offers free standard US Postal shipping (3 - 7 days)  within the United States, and US Postal Priority Mail (1 - 3 days) for a flat fee of $20.00 regardless of order total, size, and weight. You can also select US Postal next-day service, which will be quoted during checkout based on the weight of your order and your delivery address.
 

Q. How can I track my order status?

A. Visit the account login page on swae.us and sign in – there, you may review your order status. If you checked out as a guest, you may contact us at info@swae.us for your current status. The courier will email a tracking number once the item has been shipped 
 

Q. Why isn’t my order status updated when I log into my account?

A. Please allow up to 5 days for order fulfillment to be logged. Afterward, contact info@swae.us. 
 

Q. Tracking shows my label has been created, but no movement. Why is this?

A. Order fulfillment may take up to 5 days. The postal company may be combating supply chain issues. For more information or confirmation of shipment contact info@swae.us
 

Q. My package shows as “Delivered” but I never received it. What should I do?

Based on your location and pre-set preferences with the delivery courier, your order may be delivered to your building doorman, concierge, mailroom, or even at times, a neighbor may accept the package in your absence. Please be sure to check with these individuals first. If you still do not have your package 24 hours after the delivery has occurred, please contact our Support Team at info@swae.us and we will investigate the issue further.
 

Q. Do you offer same-day delivery?

A. Unfortunately, SWAE does not offer same-day delivery. 

Q. Can I expedite my order?

A. Expedited shipping is available upon checkout, SWAE does not offer expedited fulfillment. 

Q. Can I pick up my order from SWAE?

A. SWAE does not offer order pickup, as our fulfillment is out of a facility closed to the public. Contacting one of our fulfillment agents, we may be able to accommodate you at info@swae.us in the case of special extenuating circumstances.  
 

Q. Can I pick up my order from my local UPS store?

A. Domestic U.S. orders may be held at a local UPS store for customer pickup. This option is available upon checkout. 

Returns

Q. How do I return my online order?

A. We offer a 30-day return for eligible merchandise. Refunds are provided in the form of online store credit matching the value of the item, excluding original shipping costs, and include an $8 restocking fee.
 

Q. What is your Return Policy?

A. All items and orders are carefully inspected before being shipped to ensure quality and accuracy. SWAE will accept exchanges for store credit for the full order, minus shipping costs. If you notify us by email at info@swae.us within 10 business days of carrier delivery (according to carrier tracking data). All merchandise must be returned in new, unused condition and include all tags and packaging in order to qualify for a credit. Once we receive your request, we will issue you a return authorization number and additional return instructions, and your package must be postmarked and sent using an insured and trackable shipping method within 5 business days of receiving your return authorization number. Packages sent without a return authorization number will be refused. You are responsible for all return shipping costs and insurance.
 

Q. When can I expect to receive my store credit for a return?

A. Please allow 14 to 21 business days from the day we receive the return for your account to be credited.
 

Exchanges

Q. Does SWAE have an exchange policy?

A. Yes, on qualifying items, for resizing. Please notify us at info@swae.us, to arrange qualifying exchanges. 

Q. How do I return/exchange my international order?

A. Customs fee can apply and they are also to be taken charge of by the client. Follow the same returns procedure for US returns. For further questions contact info@swae.us. 
 

You have 30 days to return an item. We only accept returns if the label is still present on the product and it has never been worn. 

Q. Q. Can you reserve the item(s) on my exchange order?

A. If you would like to make an exchange of size/color, write “Exchange” on the return form and the size/color you would like to exchange it for. If the item is in stock, we will ship it out to you 3-to 5 businesses after we receive the returned item. This will reserve the item.

SWAE's privacy and security measures are designed with the strictest security in mind, so any personal information that you provide to SWAE is used for the purpose of receiving SWAE communications and for personalizing and enhancing your web experience with SWAE. SWAE's privacy policy is outlined below and tells you how we collect personal information, what information we collect, how we use it, to whom we will disclose it and how you can access, change and remove your information.

HOW WE COLLECT THE INFORMATION

There are many ways that SWAE may obtain information from you: (1) via sign up on any SWAE website(s); (2) from an online, email, retail, fax or telephone purchase; (3) from navigational information about where visitors go on our website; (4) when you enter any SWAE sweepstakes/giveaways; (5) any time you submit a business reply, product, or warranty card; (7) upon contacting customer service to request SWAE communications; and (8) upon signing up at an event. This information may be collected by SWAE or by vendors/service providers retained by SWAE and obligated to maintain your personal information in a confidential manner.

THE INFORMATION WE COLLECT

When you register on-line to receive our product information, you will need to provide us with your name, address and email address. When you make a purchase through SWAE's website, you also will need to give us your telephone number and credit card number so we can process your payment and contact you in the event of any problems with delivery. If you contact our customer service department, you may need to provide us with additional information so that we can respond to your questions or concerns as completely and thoroughly as possible. In order to provide users and subscribers with the most efficient and enhanced service and to better understand your preferences, we may request your gender, year of birth, sports of interest, shopping preference and product interest. Whether or not you provide this information is entirely up to you. We also may collect additional non-personally identifiable information (for example, browser version, IP address) which will provide information regarding the general use of our website. The navigational information allows us to see which areas of our website are most visited and helps us improve the quality of your online experience by recognizing and delivering more of the most desired features and services.

HOW WE USE THE INFORMATION

All personal information that we obtain about you will be recorded, used and protected by us in accordance with current data protection legislation and this privacy policy. By providing us with your personal information, you consent to us processing this personal information in one or more of the ways described in this privacy policy. We will primarily use your personal information to provide products and services to you, for example:

To administer a contest, promotion, survey or other site feature and to provide you with the relevant products or services (for instance to deliver a prize you may have won in a contest).

To send you information/materials via email or mail about products, offers and news we think could interest you. This information may relate to products, offers and news of Company. We only send you this if you have opted-in to receive Company catalogs or email messages.

The information we ask for when you order on-line is used only to complete the order, to confirm the order and to confirm shipment of the order. You may, upon placement of an order, opt to allow Company to save the information for a speedier checkout process the next time. California consumers have the right to request access to their personal data, additional details about our information practices and deletion of their personal data (subject to certain exceptions). California consumers also have the right to opt out of sales of personal data, if applicable. We describe how California consumers can exercise their rights under the CCPA below. Please note that you may designate an authorized agent to exercise these rights on your behalf by providing written materials demonstrating that you have granted the authorized agent power of attorney. Please note that if an authorized agent submits a request on your behalf, we may need to contact you to verify your identity and protect the security of your personal data. We will not discriminate against you if you choose to exercise your rights under the CCPA.

SWAE will never sell any information about you to anyone.  We engage third parties to perform services in connection with the operation of our business. We may need to share personal information with these third parties so that they can perform these services, however, we limit the personal information that we give to them and authorize them to use this information only for the purpose of performing those services. In proceeding with your online order, you agree that both your name and address and those of the delivery name and address (if different) will be checked using third parties such as credit agencies. If you are providing a delivery name and address which is not your own you must have that person’s permission to give us their personal information and for us to use it for the purposes specified. Company has a company policy not to flood people with email correspondence, but simply to give you periodic information so you can stay up to date on what Company is offering. Company will send emails to you only if you ask for them and you can easily unsubscribe at any time you want by calling our customer service department at (323)510-4050 or by following the instructions contained in the email. Company also uses your email address to confirm your order and to confirm shipment of your order and to respond to any inquiries you make on-line. All emails you receive will provide you with information as to how to get off the email mailing list if you so desire.

If you are under 14, you should surf swae.us only with involvement of a parent or guardian. Although SWAE does not specifically direct its website, catalogs or emails to children, SWAE strives to provide children with as much customer service as possible without violating their privacy rights. For their protection, SWAE asks that anyone under 14 years of age not attempt to register with SWAE or otherwise provide SWAE with any personal information without the consent of a parent or legal guardian.

ACCESS TO YOUR PERSONAL INFORMATION

Company will provide you with access to the personal information you provided to Company by allowing you to view, update or correct your information. In order to protect your privacy, Company takes steps to verify your identity before granting you access to the private information or enabling you to make corrections. OPT OUT / UNSUBSCRIBE

You may request to stop receiving communications from SWAE at any time. You can choose to cancel emails only, snail mail only or both by calling our customer service department at (406) 417-3690. Also, all emails you receive will provide you with information as to how to get off the email mailing list if you so desire. It takes some time to put opt-outs in effect so you may still receive catalogs or emails from Company for several weeks after your request is received. In connection with this license, you may download Materials, provided that you do not modify or alter the Materials in any way, nor delete, obscure, or change any copyright, trademark, or other intellectual property notice therein.

You may include a link to the SWAE website on one or more other websites operated by you, provided such websites link to the home page (swae.us) only and you are not linking from any site or service that violates any of the below “Restrictions on Use” or that is or contains Malicious Code (as defined below) and/or content that is disparaging, abusive, harassing, illegal, discriminatory, fraudulent, or violates the intellectual property, privacy, or other rights of SWAE or any person or entity. All Services and Materials, any improvements or modifications to such Services and Materials, any derivative works based thereon, and the collection, arrangement and assembly of all such Services and Materials, are, except as otherwise expressly stated herein, owned exclusively by SWAE or its licensors, and SWAE (and, as applicable, its licensors) reserve all rights therein. The contents of the Services and Materials are protected by the United States and worldwide copyright and intellectual property laws and treaty provisions. The trademarks, service marks, trade names, logos, and other identifiers used in or in connection with the Services and Materials are the proprietary service marks or trademarks of SWAE, its licensors, or third parties, and are protected in the United States and internationally. No copying, modification or use of any of these marks or identifiers may be made without the prior, written authorization of SWAE or its licensors (as applicable). Except as expressly set forth above, nothing in this Agreement shall be deemed to grant to you or any other individual or entity any license or right in or to any copyright, trademark, trade secret or other proprietary right, whether owned by SWAE, its licensors, or any other person.

 

Limitations of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, NEITHER SWAE, ITS PARTNERS, NOR ANY OF ITS OR THEIR THIRD PARTY PROVIDERS OR LICENSORS WILL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, AND CONSEQUENTIAL DAMAGES, EVEN IF SWAE HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, OR PERFORMANCE OF THE SERVICES, OR ANY MATERIALS, PAGES, OR CONTENT ACCESSIBLE VIA THE SERVICES, NOR WILL SWAE, ITS PARTNERS, OR ANY OF ITS OR THEIR THIRD PARTY PROVIDERS OR LICENSORS BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE WHETHER OR NOT CAUSED BY EVENTS BEYOND THEIR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, COMMUNICATIONS LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO OUR RECORDS, MATERIALS, OR SERVICES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, SWAE’S AGGREGATE LIABILITY UNDER THIS AGREEMENT, COMBINED WITH THAT OF SWAE’S PARTNERS AND ITS AND THEIR THIRD PARTY PROVIDERS AND LICENSORS, WHETHER IN CONTRACT, TORT OR OTHERWISE, SHALL NOT EXCEED AN AMOUNT EQUAL TO THE TOTAL AMOUNTS YOU PAID TO US UNDER THIS AGREEMENT; PROVIDED, HOWEVER, THAT THE FOREGOING LIMITATION ON LIABILITY SHALL NOT APPLY WITH RESPECT TO ANY LIABILITY ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold SWAE, its partners, its licensors, and its and their affiliates, members, officers, directors, managers, partners, employees, consultants, temporary resources, agents, suppliers, providers, contractors, subcontractors, licensors, successors, transferees, and assignees harmless from and against any and all damages, liabilities, actions, causes of action, suits, claims, demands, losses, costs and expenses (including without limitation reasonable attorneys’ fees, disbursements and court costs, including any incurred in enforcement of this indemnification provision) arising from or in connection with (a) your use of the Services, or any Materials, content, information, or services contained, displayed, available or accessible on or from the Services; (b) your violation of these Terms and Conditions; (c) any Submission (as defined below) provided by you to SWAE; or (d) your violation of any rights of any third party.

Submissions

While SWAE appreciates your comments and is happy to answer your questions about our products, our services, and our company, we generally do not accept ideas, know-how, inventions or suggestions for products and services (“Submissions”). This is for your protection and for ours, and to avoid misunderstanding about the origin of Submissions between you and SWAE.

Please note that any Submissions, remarks, graphics, or other information provided by you by any means, including through the Services, email, a “Contact Us” form, any “Live Chat” functionality on the Services, or otherwise, is and will be non-confidential and non-proprietary, except to the extent that such contains or constitutes personal information, which is subject to the guidelines established in our Privacy Statement. 

Arbitration; Class Action Waiver; Jury Trial Waiver; Enforcement of Terms and Conditions; Governing Law

You acknowledge and agree that the terms contained in this Terms and Conditions are reasonable and necessary and that your actual or threatened breach of this Terms and Conditions would give rise to irreparable harm to SWAE for which monetary damages would not constitute an adequate remedy and, in addition to any and all other rights that may be available in respect of such breach or threatened breach, will entitle SWAE to immediate injunctive and other equitable relief without any requirement to post bond.

These Terms and Conditions are governed and interpreted pursuant to the laws of the State of New York, United States of America, notwithstanding any principles of conflicts of law. SWAE makes no representation that Materials provided through the Services are applicable or appropriate for use in all locations. If you use the Services from other locations you are responsible for compliance with applicable local laws. If you take legal action relating to these Terms and Conditions or your interactions with or relationship to SWAE that is not subject to arbitration as provided below, you agree to file such action only in the state and federal courts located in New York County, New York and waive any objection you may have to the venue or forum.

Any controversy or claim between you and SWAE arising out of or relating to these Terms and Conditions, or breach thereof, including disputes with respect to whether the subject matter of any controversy or claim is within the scope of the Terms and Conditions, will be resolved by binding arbitration in New York County, New York under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and administered by the AAA. The parties explicitly disclaim any applicability of the U.N. Convention on Contracts for the International Sale of Goods to these Terms and Conditions. All arbitration proceedings will be conducted in English. Such arbitration will have one (1) neutral arbitrator if the amount in controversy is less than one million dollars ($1,000,000) or otherwise before a panel of three (3) neutral arbitrators. Each of the arbitrators must be i) a lawyer licensed to practice law in the United States with a minimum of fifteen (15) years of legal practice or senior level business experience or a retired judge with a minimum of five (5) years of service on the bench, ii) an individual with at least five (5) years of experience as an arbitrator, and iii) on the roster of neutrals of the AAA or similar nationally recognized ADR organization. If the arbitration proceedings shall be conducted before a panel of three neutral arbitrators, the panel shall be selected using the following process: Within fifteen (15) days after the commencement of arbitration, SWAE and you shall each select one person meeting the specified qualifications to act as neutral arbitrator, and the two thus selected shall select a third neutral arbitrator meeting the specified qualifications within fifteen (15) days of their appointment. The third neutral arbitrator shall act as the chair of the arbitration panel. If the arbitrators selected by SWAE and you are unable to or fail to agree upon the third arbitrator, the third arbitrator shall be selected by the AAA.

Neither you nor SWAE will participate in a class action or class-wide arbitration for any claims covered by these Terms and Conditions. Any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated or representative action. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, SUIT, CLAIM OR PROCEEDING BROUGHT TO ENFORCE, DEFEND OR INTERPRET ANY RIGHTS OR REMEDIES ARISING HEREUNDER, RELATING TO OR IN CONNECTION WITH THESE TERMS AND CONDITIONS.
